These General Conditions of Sale are valid exclusively between Agrispazio (website agrispazio.it), owned by Società Agricola Giorgio Mercandelli SSA, with registered office in Via Casabassa 49, 27044 – Canneto Pavese, VAT number 02495870186, and any natural person or legal entity, whether consumer or professional, hereinafter referred to as "Customer", who makes online purchases through the website www.agrispazio.it.
Giorgio Mercandelli SSA, in the person of the legal representative; address: Via Casabassa 49, Canneto Pavese (PV) – postal code 27044 – Italy; email address: info@agrispazio.it, as independent data controller, pays the utmost attention to the security and confidentiality of Personal Data in carrying out its respective activities.
Giorgio Mercandelli SSA deals with:
– manage the website www.agrispazio.it;
– manage the IT and/or telematic tools used to provide the product purchase service and other services provided by the website www.agrispazio.it;
– organize the online sales activity on the website www.agrispazio.it.
Giorgio Mercandelli SSA. may modify, in whole or in part, these general conditions, applying the new agreements from the date of their publication on Agrispazio. In any case, such changes will not have any retroactive effect on previously concluded contracts.
All purchases of products made through www.agrispazio.it are governed by these conditions in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, amended by Legislative Decree no. 21/2014 and Legislative Decree no. 70/2003 regarding electronic commerce. For anything not covered in these General Conditions, the Parties expressly refer to the provisions of the law.

ARTICLE 1 – Content and Object of the contract
These General Conditions of Sale regulate the contracts with which Agrispazio sells and the Customer purchases remotely, via telematic network, the goods and any services relating to these accessories, offered by www.agrispazio.it, and regulate the rights and obligations arising from the contract thus concluded.
The contract is concluded exclusively via the internet according to the purchase procedure provided by Agrispazio.
The Customer undertakes to read these General Conditions of Sale before confirming their order.

ARTICLE 2 – Pre-contractual information for the consumer – art. 49 of Legislative Decree no. 206/2005
The Customer, before concluding the purchase contract, examines the characteristics of the goods which are illustrated in the individual product sheets available on www.agrispazio.it.
In order to make the purchase of products clear and transparent, the product sheets declare the characteristics, dimensions and price of the products marketed, accompanied, where possible, by images that can illustrate the characteristics of the product and/or its packaging. Agrispazio undertakes to describe and present the products sold on the site in the best possible way, according to correctness and good faith. It is understood that the images of the products, where available, have the sole purpose of presenting them for sale; in the event of a difference between the image and the product sheet, the description contained in the product sheet always prevails.
Before the conclusion of the purchase contract and before the validation of the order, the Customer is informed regarding:
total price of the goods including taxes, with details of shipping costs and any other costs;
terms of payment;
conditions, terms and procedures for exercising the right of withdrawal (art. 7 of these conditions);

ARTICLE 3 – Conclusion and effectiveness of the contract
The contract for the sale of products on www.agrispazio.it is considered concluded with the sending of an order confirmation email to the Customer. The email contains the Customer's data and an order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent.
The Customer undertakes to verify the correctness of the personal data contained therein and to promptly communicate any corrections to Agrispazio. Possible additional costs caused by errors in the data not reported promptly will be the sole responsibility of the Customer.
Agrispazio has the right to accept or not, at its discretion, the order sent by the Customer without the latter being able to make claims or rights of any kind, for any reason, including compensation, in the event of non-acceptance of the order itself.
In particular, Agrispazio reserves the right not to accept purchase proposals and cancel orders that do not give sufficient guarantees of solvency or if - also following a comparison with the circuit that manages credit card payments - anomalies are found in the transactions and means of payment used by the Customer.

ARTICLE 4 – Availability of products
Product availability refers to the actual availability at the time the Customer places the order. This availability must however be considered purely indicative because, due to the simultaneous presence of multiple users on agrispazio.it, the products could be sold to other Customers before the order is confirmed.
If the Customer requests cancellation of the order, terminating the contract, Agrispazio will refund the amount paid within 14 days from the day on which it became aware of the Customer's decision to terminate the contract.

ARTICLE 5 – Payment methods
Purchases made on the website www.agripazio.it can be paid by credit card, American Express, PayPal and bank transfer.
Every purchase takes place in maximum security thanks to the use of the most advanced technological systems in the field of e-commerce and with coding systems (SSL) to protect your personal data and credit card information from unauthorized access.
Once the order has been completed, the Customer receives a confirmation email within a maximum of 24 hours containing his Order Number and a summary of the details of his purchase; you will be able to check the status of your order at any time in the appropriate section of your profile only if you have created an account.
Refunds will be made using the same payment method used for the purchase.
If the Customer needs an electronic invoice, once the order has been placed he will have to send the billing data via our customer service (ordini@agrispazio.it).

In the event that payment is made by bank transfer, the purchased products will be shipped upon receipt of the credit.

ARTICLE 6 – Prices
All sales prices of the products indicated on the site are expressed in Euros and include VAT, as required by law.
Shipping costs are not included in the purchase price, but are indicated and calculated at the conclusion of the purchase process before making the payment.
The Customer accepts Agrispazio's right to change prices at any time; however, the goods will be invoiced based on the prices indicated on agrispazio.it at the time the order is created and indicated in the confirmation email sent to the Customer.
In the event of an IT, manual, technical or any other type of error which could lead to a substantial change, not foreseen by Agrispazio, in the public sale price, which makes it exorbitant or clearly negligible, the purchase order will be considered invalid and canceled and the amount paid by the Customer will be refunded within 14 days from the day of cancellation.

ARTICLE 7 – Non-conformity of products and defective products
In the event of receipt of products that do not conform to the orders or are defective, the Customer has the right to have the conformity of the product restored free of charge by replacing it.
Upon delivery of the products by the courier appointed by Agrispazio, the Customer is required to scrupulously check: a) that the packaging is not damaged or otherwise altered; b) that the number of pieces delivered corresponds to that indicated in the transport document.
Any damage to the packaging and products or the mismatch in the number of pieces/packages must be immediately reported, or in any case communicated within 24 hours of delivery, by the Customer. In the event of a dispute or late communication by the Customer, Agrispazio will not refund or replace products that do not conform to the orders or are defective.
Bottles with a cork defect will be replaced and shipped to the Customer at the expense of Agrispazio after the Customer has sent the defective bottle including its original cork.

ARTICLE 8 – Delivery methods and terms
The products will be delivered by express courier to the address indicated by the Customer at the time of the order, in the following terms: – within 2-4 working days in the cities of Northern and Central-Southern Italy; – within 5-6 working days in islands, mountain areas and/or difficult to reach areas; - within 10 days abroad; these terms start from the processing of the order.
In the case of payment by bank transfer, provided for by art. 5 of these General Conditions, the order will be processed only after the completion of the operation, meaning the crediting of the payment of the price to Agrispazio's current account.
The following countries are enabled for online purchasing: Austria (AT), Belgium (BE), France (FR), Germany (DE), Luxembourg (LU), Holland (NL), Croatia (HR), Denmark (DK), Finland (FI), Greece (GR), Ireland (IE), Portugal (PT), Spain (ES), Sweden (SE), Bulgaria (BG), Estonia (EE), Latvia (LV), Lithuania (LT), Poland (PL), Czech Republic (CZ), Romania (RO), Slovakia (SK), Slovenia (SI), Hungary (HU).

Shipping cost:
- Italy, excluding Calabria, Sicily and Sardinia: €8, free for purchases over €140
- Calabria, Sicily and Sardinia: €12, free for purchases over €150
- Eligible EU countries: €20, free for purchases over €300

ARTICLE 9 – Responsibility
Agrispazio assumes no responsibility for disservices attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disservices of the internet network, in the event that it is unable to execute the order within the times established by the contract.
Furthermore, cases of force majeure, unavailability of means of transport, as well as unforeseeable or unavoidable events that cause a delay in deliveries or make deliveries difficult or impossible or cause a significant increase in the cost of delivery borne by Agrispazio, will give the right to this last to split, postpone or cancel, in whole or in part, the expected delivery or to terminate the purchase contract. In such cases, Agrispazio will be responsible for providing timely and adequate communication of its decisions to the email address indicated by the Customer and the latter will have the right to a refund of any price already paid, excluding any further claim, for any reason, against of Agrispazio.

ARTICLE 10 – Access to the site and intellectual property rights
The Customer has the right to access the agrispazio.it website for consultation and making purchases. No other use, especially commercial, of the site and its contents is permitted.
All trademarks (registered or otherwise), as well as any intellectual work, distinctive sign or name, image, photograph, written or graphic text, the technology used on the agrispazio.it website, and more generally any other intangible asset protected by laws and international conventions regarding intellectual property and industrial property, reproduced on the same site remain the exclusive property of Agrispazio and/or its licensors, without access to the site and/or the conclusion of purchase contracts of the products gives the Customer no rights over them.
Any use, even partial, of the same is prohibited without the prior written authorization of Agrispazio and/or its assignors, in whose favor all related rights are exclusively reserved.

ARTICLE 12 – Integrality
These General Conditions of Sale are made up of all the clauses that compose them. If one or more provisions of these General Conditions of Sale are considered invalid or declared as such pursuant to the relevant law or regulations, or following a decision by a judicial authority, the other provisions will continue to have full force and effect.

ARTICLE 13 – Applicable law and competent court
These General Conditions of Sale are subject to Italian law.
Any dispute that may arise in relation to the interpretation and execution of the purchase contract for the products on the site will be the exclusive jurisdiction of the Court of Milan.
In any case, it is possible to optionally resort to the mediation procedures referred to in Legislative Decree no. 28/2010, for the resolution of any disputes arising in the interpretation and execution of these conditions of sale.
